La collana, diretta dalla prof. ssa Laura Guercio e dalla prof. ssa Marta Bordignon, intende sviluppare un progetto di analisi e studio di una prospettiva innovativa dei diritti umani che si ponga come alternativa alla rigida contrapposizione tra la teoria del relativismo e la teoria dell’universalismo.
La ricerca è volta a comprendere se e quanto i principi dei diritti umani possano ammettere diverse declinazioni contestuali, sia pure nel rispetto della inviolabilità degli stessi principi.
Ciò significa respingere, come unica alternativa, la sfida tra relativismo e universalismo, per invece sviluppare un modello basato sulla dialettica dei due diversi approcci: è attraverso tale dialettica che è ipotizzabile lo sviluppo di una nozione di universalismo formale che viene sostanzialmente arricchito e indirizzato dall’autenticità delle esemplarità locali, caratterizzate da specifiche società e culture. L’universalismo pluralistico mantiene così i criteri di filtraggio formali per reinterpretare, da una parte, il pluralismo sociale e culturale in cui tali criteri devono affermarsi, ma nel contempo per conferire a questi ultimi fissità e validità sostanziale.
In una società quale quella attuale, è possibile addivenire alla affermazione di questo nuovo approccio?
Quali sono gli strumenti sviluppare tale risultato?
Il progetto, oggetto della presente collana, intende rispondere a tale domande.
Sociology and Rights
The book series “Sociology and Rights”, led by Laura Guercio and Marta Bordignon, is intended to conduct an analytical research aimed at introducing an innovative perspective on human rights as an alternative to the rigid contrast between relativism and universalism.
The research project is finalized at understanding wheter and to what extent human rights principles could be classified under various context, by respecting the cogent principle of their inviolable nature. This means to reject, as unique choice, the challenge posed by relativism and universalism, in order to outline a model based on a dialogue between both approaches: it is through such a dialogue that a formal concept of universalism could be developed, could be enriched and led by real local examples, characterized by specific cultures and civil societies.
The pluralistic universalism thus holds the formal filtering criteria for reinterpreting, on one hand, the social and cultural pluralism where such criteria have to be affirmed; and, on the other hand, for giving them a significant value.
Is it then possible, in the current society, to affirm this innovative approach? And which are the tools available for implementing such a result? Against this background, the main objective of this book series is to reply to these questions.
DIREZIONE
Laura Guercio is a lawyer at a firm in Genoa and Rome (Italy) and also have experience in other jurisdictions (such as Great Britain/Republic of Ireland). Guercio completed her doctoral studies in political science with co-supervisors at the University of Genoa and Trinity College Dublin (on the topic of ‘Women’s Rights in the Constitutional Reforms in the Mena Area after the Arab Spring’). She also has a masters in ‘National, European and International Jurisdictions’ from SIOI-University of Rome Tor Vergata-Universiy of Camerino. Currently she is a Professor at the University of Perugia and Secretary General of the Inter-Ministerial Committee for Human Rights at the Italian Ministry of Foreign Affairs. In addition, she is an Italian Agent at the Management Board of the European Fundamental Rights Agency and assistant lawyer before the International Criminal Court. Since 2010 she has been a Senior Researcher in EU and in international projects in the Mena area with the support of Italian Ministry of Foreign Affairs.

Marta Bordigon, dottore di ricerca in diritto pubblico internazionale presso l’Università di Roma “Tor Vergata”, con una tesi sull’implementazione da parte degli Stati – in particolare Italia, Regno Unito e Spagna – e dell’Unione Europea dei Principi Guida ONU in materia di Impresa e Diritti Umani. Co-fondatrice e Presidente da maggio 2018 dell’Associazione Human Rights International Corner (HRIC – www.humanrightsic.com). Assistente di ricerca presso l’Università di Siviglia (Spagna) e membro dell’Osservatorio spagnolo Diritti Umani e Imprese. Membro del Comitato di Coordinamento del Gruppo di Interesse “International Business and Human Rights” della Società Europea di Diritto Internazionale (ESIL). Professore di Politica Europea Contemporanea presso la Temple University, Campus di Roma.
Dr. Bordignon holds a MA in International Relations and a BA in Political Science at “LUISS Guido Carli” University, Rome. She is Research Assistant at the University of Seville (Spain) and member of the Spanish Observatory on Human Rights and Business. She is even member of the Coordinating Committee of the Interest Group on International Business and Human Rights of the European Society of International Law (ESIL). In addition to teaching, she is co-founder of the association “Human Rights International Corner – HRIC ETS” (www.humanrightsic.com), of which she has been appointed President in May 2018. She authored many research papers and articles on international relations, business and human rights, transition studies and development cooperation.
